JATIMTIMES - Setelah lebih dari dua dekade tertunda, Rancangan Undang-Undang Perlindungan Pekerja Rumah Tangga (RUU PPRT) akhirnya resmi disahkan menjadi undang-undang oleh DPR RI. Pengesahan ini berlangsung dalam rapat paripurna pada Selasa, 21 April 2026, bertepatan dengan peringatan Hari Kartini.

Ketua DPR, Puan Maharani, menyebut momen ini sebagai tonggak penting bagi pekerja rumah tangga di Indonesia yang selama ini belum memiliki payung hukum yang jelas.

“Setelah 22 tahun diperjuangkan, hari ini UU PPRT telah disahkan. Ini menjadi tonggak sejarah bagi pekerja di sektor domestik,” ujarnya dalam sidang paripurna.

Struktur dan Cakupan UU PPRT

Undang-undang ini terdiri dari 12 bab dan 37 pasal yang mengatur secara komprehensif hak, kewajiban, serta perlindungan bagi pekerja rumah tangga (PRT), termasuk hubungan kerja dengan pemberi kerja dan perusahaan penyalur.

Larangan untuk Perusahaan Penyalur PRT (P3RT)

Salah satu poin krusial dalam UU ini adalah pengaturan terhadap Perusahaan Penempatan Pekerja Rumah Tangga (P3RT). Dalam Pasal 28, ditegaskan sejumlah larangan, antara lain:

• Tidak boleh memotong upah atau menarik biaya dalam bentuk apa pun dari PRT

• Dilarang menahan dokumen pribadi milik pekerja

• Tidak boleh membatasi akses komunikasi PRT

• Dilarang menempatkan PRT ke badan usaha selain pemberi kerja perseorangan

• Tidak boleh memaksa perpanjangan kontrak secara sepihak

Jika melanggar, perusahaan dapat dikenai sanksi administratif mulai dari teguran hingga pencabutan izin usaha.

Hak-Hak Pekerja Rumah Tangga

UU PPRT juga secara tegas mengatur hak-hak dasar pekerja rumah tangga yang sebelumnya kerap diabaikan. Dalam Pasal 15, disebutkan bahwa PRT berhak:

• Menjalankan ibadah sesuai keyakinan

• Mendapatkan waktu kerja yang manusiawi dan waktu istirahat

• Memperoleh cuti berdasarkan kesepakatan kerja

• Menerima upah dan tunjangan hari raya (THR)

• Mendapatkan jaminan sosial kesehatan dan ketenagakerjaan

• Mendapatkan makanan sehat dan tempat tinggal layak (untuk PRT tinggal di rumah majikan)

• Bekerja dalam lingkungan yang aman dan sehat

• Mengakhiri hubungan kerja jika kesepakatan dilanggar

• Besaran upah dan waktu pembayarannya akan diatur lebih lanjut dalam Peraturan Pemerintah.

Mekanisme Penyelesaian Perselisihan

UU ini juga mengatur mekanisme penyelesaian konflik antara PRT, pemberi kerja, dan perusahaan penyalur. Prosesnya dilakukan secara bertahap:

• Musyawarah mufakat maksimal 7 hari sejak permintaan diajukan

• Jika gagal, dilanjutkan dengan mediasi oleh ketua RT/RW atau mediator dari instansi ketenagakerjaan

• Proses mediasi juga dibatasi maksimal 7 hari sejak laporan diterima

• Momen Pengesahan yang Penuh Haru

Pengesahan UU PPRT berlangsung di ruang rapat paripurna DPR RI di Senayan, Jakarta. Suasana sempat riuh ketika komunitas pekerja rumah tangga yang hadir di balkon menyambut momen bersejarah tersebut dengan antusias.

Menteri Hukum, Supratman Andi Agtas, turut mengapresiasi kehadiran para pekerja rumah tangga yang menyaksikan langsung pengesahan tersebut.

Ia menyebut mereka sebagai “fraksi balkon” yang ikut merasakan kebahagiaan atas lahirnya undang-undang ini.

Disahkannya UU PPRT menjadi langkah besar dalam memberikan kepastian hukum dan perlindungan bagi jutaan pekerja rumah tangga di Indonesia. Regulasi ini diharapkan mampu menghapus praktik eksploitasi serta meningkatkan kesejahteraan pekerja sektor domestik.
